ARTICLE XIII. LEGAL STATUS

When sections of this Chapter impose higher standards than required in any other statute, local ordinance or
regulation, this Chapter shall govern. When the provisions of any other statute, local ordinance or regulation impose
higher standards than are required by this Chapter, the provision of that statute, local ordinance or regulation shall
govern.

It is hereby declared to be the intention of the Board of Commissioners that the sections, paragraphs, sentences,
clauses and phrases of this Chapter are severable, and if any phrase, clause, sentence, paragraph or section of this
Chapter shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction,
such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of
this Chapter, since the same would have been enacted by the Board of Commissioners without the incorporation in
this Chapter of any such unconstitutional phrase, clause, sentence, paragraph or section.

All ordinances or portions thereof, of the Code of Ordinances of Henderson County, North Carolina which are related to zoning, subdivision and land use which are inconsistent with the provisions of the Chapter are hereby repealed to the extent of such inconsistency

Whenever reference is made to a resolution, ordinance, statute, regulation, manual (including the Stormwater BMP Manual), or document, it shall be construed as a reference to the most recent edition of such that has been finalized and published with due provision for notice and comment, unless otherwise specifically stated.
