Ecusta Trail Encroachments

Henderson County has a formal process for approving all items placed on the Ecusta Trail property. This policy allows county residents to add benches, gardens, artwork or other items to the trail, with the aim of improving the Ecusta Trail experience for all. Property owners or businesses looking to add a connection to the Ecusta Trail can also apply to do so under this policy.

All applications for new encroachments or trail connections will be reviewed by the Planning Department before being approved or denied by the Henderson County Rail-Trail Advisory Committee. The County’s full Non-Utility Encroachment Policy can be found below.

Apply for an Encroachment Permit

Henderson County accepts encroachment permit applications online via the Citizen Portal(Directions on how to sign up for a citizen portal account and how to create a permit online)

  • Encroachment Applications require a Site Plan showing the location of the proposed encroachment along the trail, as well as photos of the location on the Ecusta Trail.
  • Applicants must submit a signed copy of the Non-Utility Encroachment Ceritifications.
  • Henderson County may require additional documentation depending on the type of proposed encroachment.

All Encroachment applications will be reviewed by the Planning Department before being approved or denied by the Henderson County Rail-Trail Advisory Committee. The Rail-Trail Advisory Committee meets on the 2nd Wednesday of each month at 10:00 AM in the King Street Meeting Room.
